- By accessing the ICC Online Media Zone (the “OMZ”) and using the written material, photographs, non-match audio visual material, match footage, audio updates, and any other content uploaded to the OMZ (together, the “Content”), you acknowledge and agree that your access to the OMZ and your use of the Content shall be subject to these Terms of Use.
- If you are accessing the OMZ on behalf of your employer or other entity, you warrant and represent that you have the full right and authority to do so and to accept these Terms of Use and liability for any breaches on behalf of yourself and such employer or entity. In the event that you do not have such authority, you alone will be personally liable for any breaches of these Terms of Use.
- Subject to your compliance with these Terms of Use, ICC Business Corporation FZ LLC (“IBC”) hereby grants you a worldwide, royalty-free, revocable, limited licence to use the Content for non-commercial editorial purposes in accordance with the restrictions set out in clauses 4 and 5 below.
- Content shall not be used, redistributed, shared or transferred:
(a) other than in accordance with these Terms of Use;
(b) in a manner that could be considered deceptive, obscene, offensive, defamatory or illegal;
(c) for commercial or non-editorial purposes;
(d) in a matter that misrepresents the source of the Content; or
(e) without the correct attribution as set out in clauses 6 and 7 below - Match footage shall not be used on social media platforms (including but not limited to Facebook, YouTube, Instagram and/or Twitter), but you may provide links on social media platforms where such match footage is used elsewhere (for example, on a website).
- Other than the cropping of photographic images, the clipping of footage and audio updates, and the use of excerpts from written material, you may not modify Content and must ensure that its use does not misrepresent the context in which it has been provided in the OMZ.
- Content shall be attributed as follows: (a) Written or photographic content shall carry the following attribution in a clearly visible and appropriately positioned location: © ICC Business Corporation FZ LLC 2020 (b) Footage shall carry the following wording in a clearly visible location for its entirety: Courtesy of ICC
- Whilst IBC shall make reasonable efforts to ensure the accuracy of information provided with the Content, no warranties or representations are made in relation to the accuracy of the information in the OMZ. The Content is provided ‘as is’ and IBC does not warrant that it will meet your requirements or that your use of the OMZ will be uninterrupted or free from error.
- IBC shall not be liable to you or any other person for any damages, costs or losses arising from your use of the Content, from inaccurate information in the OMZ, as a result of modifications made to the Content, or due to the context in which you use the Content. Some Content may contain elements that require additional clearance for use in a particular context. If you use Content in such context, you are solely responsible for obtaining any additional clearances thereby required.
- You shall indemnify and hold IBC harmless against any damages or liability of any kind arising from any use of the Content other than as expressly permitted by these Terms of Use.
- You shall keep secure your individual OMZ access details provided by IBC and shall ensure that they are only used by appropriately authorised individuals (whose details shall be provided to IBC in the course of registering any new users to access the OMZ).
- ICC reserves the right to withhold the distribution of any Content and may in its discretion withdraw permission to use Content that you have accessed through the OMZ.
- Any breach of these Terms of Use may lead to a suspension or withdrawal (at IBC’s absolute discretion) of your ability to access the OMZ and/or any accreditation you may hold for an ICC event.
- These Terms of Use are governed by English law and any disputes in relation to them or their subject matter shall be subject to the jurisdiction of the courts of England and Wales.
